1. Introduction
Welcome to Pulse Hospitality Group. By accessing or using our services, curriculum, or website, you agree to be bound by these Terms of Service. Please read them carefully.

2. License and Use
You are granted a limited, non-transferable license to access and use the A Sense of Pulse® curriculum solely for your organization’s internal purposes for the duration of your active, paid subscription.

You may not:

  • Copy, share, or resell any content.

  • Distribute or sub-license content to third parties (including competitors or affiliates).

  • Create derivative works based on our content.

Unauthorized use will result in termination of access and may lead to legal action.

3. Confidentiality and Trade Secrets
You acknowledge that the A Sense of Pulse® curriculum contains confidential information and trade secrets. You agree not to disclose, disseminate, or reverse-engineer the methodology or framework. This confidentiality obligation continues even after termination of access.

4. Prohibition on Derivative Works and Competing Systems
You may not use our frameworks, concepts, or terminology to:

  • Build or train others on competing systems.

  • Replicate or mimic Pulse Hospitality Group’s structure or insights.

  • Develop internal programs that mirror A Sense of Pulse®.

5. Refund Policy
Due to the proprietary nature of our digital training content, all sales are final. No refunds are provided once content has been accessed. Access is defined as viewing any portion of the curriculum or downloading related materials. No cooling-off period under New York law applies. We strongly encourage you to review complimentary teaser content first.

6. Privacy Policy
Your use of our services is also governed by our Privacy Policy.

7. Account Access and Security
You are responsible for maintaining the confidentiality of login credentials and for all activity under your account. Notify us immediately of any unauthorized access.

8. Disclaimer of Warranties
Our services and content are provided “as is” and “as available” without warranties of any kind. Content is for educational and cultural purposes only.

9. Limitation of Liability
To the maximum extent permitted by law, Pulse Hospitality Group is not liable for indirect, incidental, or consequential damages, including lost profits or revenues.

10. Indemnification
You agree to indemnify and hold harmless Pulse Hospitality Group and its affiliates from claims or damages arising from misuse or breach of these Terms.

11. Governing Law
These Terms are governed by the laws of New York, and any disputes will be resolved in New York state or federal courts.

12. Changes to Terms
We may update these Terms from time to time. Continued use of our services constitutes acceptance of updated terms.

13. Termination
We may suspend or terminate access immediately for violation of these Terms. Any breach of Sections 2-4 (License, Confidentiality, Prohibition on Derivatives) constitutes a material breach and will result in immediate termination. Such breach will trigger liquidated damages of no less than 10× the total fees paid, as a reasonable estimate of irreparable harm caused.

14. Survival
Sections 2 (License - regarding restrictions), 3 (Confidentiality), 4 (Prohibition on Derivatives), 9 (Limitation of Liability), 10 (Indemnification), and 13 (Termination effects) shall survive any termination of these Terms.
